Online Shop Terms of Use
These terms of use (hereinafter referred to as the "Terms") establish the conditions of use for the online shop (hereinafter referred to as the "Service") provided by Beach Access Co., Ltd. (hereinafter referred to as the "Company") on this website. Users (hereinafter referred to as "Users") are requested to use the Service in accordance with these Terms.
Article 1 (Application)
1. These Terms shall apply to all relationships between the User and the Company regarding the use of the Service.
2. The Company may establish rules, etc., including various provisions (hereinafter referred to as "Individual Provisions"), in addition to these Terms regarding the use of the Service. Regardless of their name, these Individual Provisions constitute part of these Terms.
3. In the event of any inconsistency between the provisions of these Terms and the provisions of the Individual Provisions referred to in the preceding paragraph, unless otherwise provided in the Individual Provisions, the provisions of the Individual Provisions shall take precedence.
Article 2 (User Registration)
1. In the Service, a person who wishes to register shall apply for registration by agreeing to these Terms and following the method prescribed by the Company, and registration shall be completed when the Company notifies the applicant of its approval.
2. The Company may not approve the registration if it determines that the applicant for registration falls under any of the following reasons, and shall not be obligated to disclose the reasons for such non-approval:
- If false information is provided at the time of registration application.
- If the applicant has violated these Terms.
- If the Company determines the registration application to be inappropriate for any other reason.
Article 3 (Management of User ID and Password)
1. Users shall be responsible for managing their user ID and password for the Service at their own risk.
2. Users may not transfer, lend, or share their user ID and password with any third party under any circumstances. If a combination of a user ID and password matches the registered information and is logged in, it will be deemed to be used by the user who registered that user ID, unless proven otherwise.
3. Except in cases where the Company has intentional or gross negligence, the Company shall not be liable for any damages arising from the use of a user ID and password by a third party.
Article 4 (Sales Contract)
1. In the Service, a sales contract shall be concluded when the User applies for a purchase to the Company and the Company notifies the User of the acceptance of such application. Ownership of the product shall transfer to the User when the Company delivers the product to the delivery company.
2. The Company may terminate the sales contract in the preceding paragraph without prior notice to the User if the User falls under any of the following reasons:
- Violation of these Terms by the User.
- Failure to complete the delivery of the product due to the recipient being unknown or absent for an extended period.
- Any other reason where the trust relationship between the Company and the User is deemed to be impaired.
3. Payment methods, delivery methods, cancellation methods for purchase applications, and return methods related to the Service shall be determined separately by the Company.
Article 5 (Intellectual Property Rights)
Copyrights and other intellectual property rights of the content provided by the Service, such as product photos and other content (hereinafter referred to as "Content"), belong to legitimate rights holders such as the Company and content providers. Users may not reproduce, reprint, modify, or otherwise use the Content without permission.
Article 6 (Prohibited Matters)
Users shall not engage in the following acts when using the Service:
1. Acts that violate laws or public order and morals.
2. Acts related to criminal activities.
3. Acts that infringe copyrights, trademark rights, or other intellectual property rights included in the Service.
4. Acts that disrupt or interfere with the functions of the Company's servers or networks.
5. Commercial use of information obtained through the Service.
6. Acts that may interfere with the operation of the Company's services.
7. Unauthorized access or attempted unauthorized access.
8. Acts of collecting or accumulating personal information of other users, etc.
9. Impersonation of other users.
10. Acts that directly or indirectly provide benefits to antisocial forces in connection with the Company's services.
11. Any other acts deemed inappropriate by the Company.
Article 7 (Suspension of Service Provision, etc.)
1. The Company may suspend or interrupt all or part of the provision of the Service without prior notice to the User if any of the following reasons apply:
- When maintenance, inspection, or update of the computer system for the Service is conducted.
- In case of force majeure such as earthquake, lightning, fire, power outage, or natural disaster making it difficult to provide the Service.
- In case of a failure of the computer or communication line, etc., due to an accident.
- In any other case where the Company deems it difficult to provide the Service.
2. The Company shall not be liable for any damages or losses incurred by the User or a third party due to the suspension or interruption of the provision of the Service for any reason.
Article 8 (Restriction on Use and Deregistration)
1. The Company may, without prior notice, restrict the use of all or part of the Service or deregister the User as a user if any of the following applies:
- Violation of any provision of these Terms.
- Discovery of false facts in the registered information.
- The credit card provided by the User for payment has been suspended.
- Failure to fulfill payment obligations such as fees.
- No response to inquiries from the Company for a certain period.
- No use of the Service for a certain period since the last use.
- Any other case where the Company deems the use of the Service to be inappropriate.
2. The Company shall not be liable for any damages incurred by the User due to actions taken by the Company under this Article.
Article 9 (Withdrawal)
Users may withdraw from the Service through the prescribed withdrawal procedure.
Article 10 (Disclaimer of Warranty and Disclaimer)
1. The Company does not guarantee that the Service is free from defects (including safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, security, etc.) in fact or legally.
2. The Company shall not be liable for any damages incurred by the User through the Service. However, if the contract between the Company and the User regarding the Service (including these Terms) falls under a consumer contract stipulated in the Consumer Contract Act, this disclaimer provision shall not apply. In this case, even in such a case, the Company shall not be liable for damages incurred by the User due to the Company's negligence (excluding gross negligence) in breach of contract or tort, except for damages arising from special circumstances.
3. The Company shall not be liable for any transactions, communications, or disputes between the User and other Users or third parties arising from the Service.
Article 11 (Change of Service Content, etc.)
The Company may change or discontinue the content of the Service or its provision without notifying the User, and shall not be liable for any damages incurred by the User as a result.
Article 12 (Amendment of Terms of Use)
The Company may change these terms of use at any time without notice to the user if deemed necessary. Upon commencement of use of this service after the amendment of these terms, the user shall be deemed to have agreed to the amended terms.
Article 13 (Handling of Personal Information)
The Company shall handle personal information obtained through the use of this service appropriately in accordance with the "Privacy Policy" of the Company.
Article 14 (Notification or Contact)
Notifications or contacts between the user and the Company shall be made in the manner prescribed by the Company. Unless otherwise notified by the user in a manner prescribed separately by the Company, notifications or contacts shall be deemed to have reached the user at the contact information currently registered at the time of transmission.
Article 15 (Prohibition of Assignment of Rights and Obligations)
Without the prior written consent of the Company, the user may not assign or pledge to a third party any rights or obligations under the usage agreement or these terms and conditions.
Article 16 (Governing Law and Jurisdiction)
In the interpretation of these terms and conditions, Japanese law shall apply. Disputes arising from this service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office.
